I think you have got that a little mixed up. It is either 40% by volume or 40 degrees proof. I hope it was % by volume

In the UK 40% alcohol by volume (ABV) would be 70 degrees proof.
In the US they would call it 80 proof or 40% alcohol by volume (ABV).
