There is another article in todays Mail on Sunday.......a criminal with infectious TB who won't be treated. The Police had to let him go because it was too dangerous to question him......they risked getting the disease......he has been hospitalsied several times but has never completed the course of treatment.......this may make the TB resistant to treatment in the future. Why can't they force him to have treatment ........? Yeah, you guessed it. It infringes his human rights. His identity cannot be disclosed because of the right to confidentiality.

You may have already added the right to marry in relation to gay marriages Tinks. I used it in one of my assignments to prove a point. We all have a right to marry the person of our choice once we reach a certain age, but some institutions ie the church will not allow gay marriages. Good luck with your essay.:D

Tinks, another example of the Human Rights Act gone awry are the cases of court ordered Caesarian Sections. There have been a few in the last 5 years and all have been reported in newspapers, so you should be able to google them. Basically women have been forced to have sections due to problems in labour/pregnancy where fears for the life of the unborn child have prevailed over the woman's right to refuse the op. The fetus has no rights in British law until it is born, but somehow the courts and doctors have managed to override the woman's wishes and enforce an operation. These are very interesting cases, as they show how the law can be bent to suit. Many of these women have been deemed to have phobias of needles etc therefore classed as psychiatric disorders and deemed incompetent to make a rational decision, even though the women knew that their babies would in all likelyhood die, or they would die themselves without the op. These women had all the information and knew what the outcome of their refusal would be but still chose to refuse treatment. The law treat them as incompetent even though they were intelligent women.

Also look into cases of enforced blood transfusion for Jehova's witnesses or children of Jehova's witnesses. You should find something interesting there too.:D

Maybe you could discuss the human rights of burglars if they were to break into someones house and get caught in the act, resulting in some summary barrack-room justice being dished out. Once a burglar breaks into a property, do they abrogate their human rights? you could discuss it with referrence to the Tony martin case; the Norfolk farmer who collared two scrotes breaking into his secluded farmhouse. much has been written about this case, as it had a very high media profile, and a massive public campaign was instigated to free him from his prison sentence.
