Human Rights Act ???
I have got an A Level essay that I have got to complete this week for college with a working title of "Basic Human Rights Are Well Protected In The UK Since The Implementation Of The Human Rights Act 1998" critically evaluate this statement.
I need it to be about 3000 words and up to now I'm only up to 1800 but I feel like I've covered every aspect. Anybody out there proficient in the workings of the Human Rights Act that can help me out before I rip my bleeding hair out :bangh8: PLEASE!!!!!!!!!! If you can't help with the essay can anyone tell me why I put myself up for this punishment again and again :mad: |

Tinks......I thought I had some gubbins on this topic. We were given a load of stuff when I was still in the nursing profession.........but I have looked high and low and I can't find it.
I rarely throw stuff like that out......but it is not with the stuff from my working days. Why don't you 'google' for some info. If I find the stuff I will let you know.........as for your last queation.......maybe you like a challenge. |

sorry can't help tinks as to why you put yourself through this punishment- think perhaps its your vocation if so go for it it'll pay off in the long run N.L.T.B.G.Y.D. good luck hope you get the info.

Track down a working Human Rights Policy related to the job intend to do and include it as a working example of the Act in Action..........

Margaret I have googled my little heart heart out already. I found a really good site called liberty.org that was full of useful information.
Cashman thanks for the good luck I'm gonna need it lol :D Doug I know were your coming from I have used examples to get my point across such as Article 3 which prohibits torture and degrading treatment or punishment I used the Iraq and US and British soldiers and hostages like Ken Bigly being shown on TV. |

Oh just had a thought......you have probably incorporated it anyway...... the right for people in Jail to vote......don't know what section it would come under.
Because of the recent election there was some stuff in the paper about prisoners human rights being contravened because they were not allowed the vote. |

you could argue that the prisoners human rights are not protected as he /she is not allowed to exercise their right to influence the democratic process.
Glad to be of help......I will keep scratching around to see if I can think of anything else. oooH what about the couple in todays Mail...... have had their children removed and put up for adoption because they are a bit 'slow'........surely that contravenes the Human Rights Act. |

1,973 words now :) thanks for that Margaret the European Court found that it does breach the right to free elections,
I'll have a look at the Mail story now, that sounds like it contravenes quite a few ! |

That story in today's DM is incredible, and more than a little frightening. The husband doesn't actually have learning difficulties and that has been admitted. He apparently has lost his temper with the busybodies but who wouldn't when you look at how many people have been interfering in their lives. The fact that the little girl was clean and well dressed and well looked after makes me wonder how the heck she came to be on the at-risk register when I've known of children really neglected and left in dirty nappies all morning while the single parnt mother slept off the effects of the night before and social services did nothing!
Sorry Tinkerbelle, total thread wander there. Have you covered the human rights of victims of crime? |

There is another article in todays Mail on Sunday.......a criminal with infectious TB who won't be treated. The Police had to let him go because it was too dangerous to question him......they risked getting the disease......he has been hospitalsied several times but has never completed the course of treatment.......this may make the TB resistant to treatment in the future. Why can't they force him to have treatment ........? Yeah, you guessed it. It infringes his human rights. His identity cannot be disclosed because of the right to confidentiality. |

You may have already added the right to marry in relation to gay marriages Tinks. I used it in one of my assignments to prove a point. We all have a right to marry the person of our choice once we reach a certain age, but some institutions ie the church will not allow gay marriages. Good luck with your essay.:D

I was going to mention the TB story in today's Mail on Sunday but you beat me to it Margaret. Lettie's point about gay marriages leads me to another interesting point too, what happens when you've got someone who has had a sex change? They may be physically female but legally male or vice versa. Where are their human rights when it comes to choosing a marriage partner?

Tinks.......I have scanned the article but the file is too large to post on here.
If you PM me your e-mail addy I will send it to you that way. The quality isn't the best and I have had to do some creative folding to get all the text on. An alternative if you don't want me to send you the scanned article would be to check if the public Library has a copy of The Daily mail from Saturday. |

Tinks, another example of the Human Rights Act gone awry are the cases of court ordered Caesarian Sections. There have been a few in the last 5 years and all have been reported in newspapers, so you should be able to google them. Basically women have been forced to have sections due to problems in labour/pregnancy where fears for the life of the unborn child have prevailed over the woman's right to refuse the op. The fetus has no rights in British law until it is born, but somehow the courts and doctors have managed to override the woman's wishes and enforce an operation. These are very interesting cases, as they show how the law can be bent to suit. Many of these women have been deemed to have phobias of needles etc therefore classed as psychiatric disorders and deemed incompetent to make a rational decision, even though the women knew that their babies would in all likelyhood die, or they would die themselves without the op. These women had all the information and knew what the outcome of their refusal would be but still chose to refuse treatment. The law treat them as incompetent even though they were intelligent women.
Also look into cases of enforced blood transfusion for Jehova's witnesses or children of Jehova's witnesses. You should find something interesting there too.:D |

Maybe you could discuss the human rights of burglars if they were to break into someones house and get caught in the act, resulting in some summary barrack-room justice being dished out. Once a burglar breaks into a property, do they abrogate their human rights? you could discuss it with referrence to the Tony martin case; the Norfolk farmer who collared two scrotes breaking into his secluded farmhouse. much has been written about this case, as it had a very high media profile, and a massive public campaign was instigated to free him from his prison sentence.

I am just on my way to college to hand the assignment in thankyou to everyone who helped out I got to 3,082 words :D been up since 7am adding Lettie and Sparkys idea but I'm done now and I hope no one mentions Human Rights for at least a month lol :( !!!

I like the one about "Right to liberty and security". Where does that leave us when idiots with rampant TB are wandering about, infecting others? Or is that covered by their "Freedom of expression"? I suppose burglars/muggers are simply exercising their right to freedom of expression as well.
I am sick of hearing about rights - why can't we have an Act that says: You do not have the right to infect others with your potentially fatal diseases. If you refused treatment, you will be either isolated or compelled to undergo a full course. Why can't somebody section this dangerous idiot? - then he could be treated/isolated and the rest of us can exercise our right to security. You do not have the right to break into someone's home with impunity. If you do so, you leave your "Human Rights" at the point of entry, and the householder/victim is entitled to defend him/herself and property. As for Willow's question about the human rights of victims of crime - forget it - they don't seem to have any. |
