Kenny started a thread on this in November and went all through Common Law and parking tickets at great length, I don't think he ever came on to announce his victory.

Simple answer, if its not the council its basically junk mail and treat it this way.

They cannot enforce the fine.

From a quick Google Excel seem a dodgy firm, just look at watchdogs website.;)

OR take the others advise stop moaning and pay the penalty. No wonder firms like Excel get away with it.:rolleyes:

I'm sure that there is a sign up on the car park telling drivers the rules of the car park.
Not that I am saying it is legal for them to issue penalties for infringement of these rules.

They have their own personnel who go round checking that cars have parked in the bays, and that you haven't overstayed the time limit. I'm not sure if the shops on the site pay the company to oversee the car park....but it is close to the town centre and as such is open to people abusing it by parking too long.

the legalities of these tickets is clear, they are NOT a fine or enforsable by any law enforcement agency. At best they are an invoice, they have never taken anyone to court to recover the charge that they are trying to apply. Throw it in the bin, you will then get about 12 different letters threatening to up the "Fine" to nearly 200 quid and from different debt collectors who are just Excel in another name(Roxbroughe IIRC?). They will even try calling you, just hang up. After about 12 months they give up.

how do I know this? because it happened to me on a different car park in Stockport but same bunch of cowboys. their sign was not visible on the route I drove in to the space or on my journey from the car to the shop I went in so I was unaware of any restriction.

the law actually says that they can issue a charge for their "Loss" however this has been rated at no more than £1 as there is no charge for parking oin these so a nominal charge is applied. I wouldn't suggest having anything to do with them, just throw all letters away and isgnore any calls.

Visited Bury (for the 1st time) parked on a carpark opposite Matalan, went to the nearest pay machine, purchased a ticket £1 for 1 hr, put it on my windscreen, came back 3/4 hr later & had a ticket, asked someone sat in their car opposite me if they knew why i might have got a ticket, and was told that where I had parked my car was in fact a separate car park. The car parks were the same tarmac, same white lines and only separated by small hooped railings which are designed for people to pass through with ease. When I went looking I found the ticket machine for the car park I was actually on £1.80 for 2 hrs. There was nothing on the ticket machine that I had purchased from to offer advise that there are in fact two separate car parks. I had my 18 month old with me so I just walked to the nearest (and the only machine I could see) as was having to weave in & out of parked cars with a pushchair. In my defence I genuinely didn't know these were two separate car parks, and that is it really thought that for the sake of a further 80p I wouldnt have got a ticket from the correct machine, which wasn't even visable from where I had parked my car as the car park was heaving. Its just a money making scam, I wont have been the first or the last to be stung, but im contesting it every step of the way.

Don't bother contesting it, just ignore it as per my post, they do hassle you with letters but just chuck them on the recycling.

I think Wallop is contesting against the council, you cannot ignore these as they will start to increase in price.

I'm not 100% but sometime you can be better to pay fines under protest to stop any additional costs and then you can just argue the original fine. (this is only for genuine fines not like Excel who just prey on the ill informed).

When you register an appeal all that happens is you lose the right to pay it at the reduced rate. It doesn't go up whilst waiting for a hearing. Think my hearings sometime in March in manchester, asked for burnley but then got a letter back saying no dates coming up at burnley, when i rang to as why they said because not many people ask for the venue, so either manchester or preston, so opted for manchester

This is a car park to serve the shops in this little area..How on earth can you be given a parking ticket here ? This should be stopped right away, and the retailers told that if it carries on, a few people will stand at the entrance to the car park and turn drivers around. Who are the few people ? well I will muster them myself, because I am livid about this.. Tesco in Chorley once hired a firm of idiots to check if drivers parked in a disabled bay where in fact badge holders, I mean badge and clock set at the time of arrival. when challenged by this little moustachioed prat, I was informed that I may be banned from the car park and my reg No kept on their file. £80 quid a week was my adverage weekly spend there, so a short trip to the managers office, and Hitler was ousted from the store with his P45 shoved up his errm thingy..........Tony

Hi Michael, Yes I am the disabled one in this case, and I had left the badge in but not the clock since I would only be a few mins anyway. The guy was arrogant to extream, and on a supermarket car park? what is the world coming to ?.. If these big companies want the trade then treat customers a bit better, or lets boycot the lot of them and bring back the corner shop.... Tony

I agree with you, Tony. I display the blue badge but usually don't display the clock on Tesco's car parks at their stores in Great Harwood and Haslingden, and no one has ever said anything to me. I can understand the need to display the clock on public roads but, like you, think it's pointless on Tesco's own car parks. They know we are inside their stores spending money.

Think the answer is to display both wherever you Park Michael, I here what your saying and understand that you shouldn't really need to use the clock on a supermarket car park, but for the time it takes it takes away the opportunity for these Jobsworths to jump in and try and make a fast buck, I always use both no matter where I park and am also very aware that the Badge doesn't give a disabled driver carte blanche as to where they can park, there are people who think they can park anywhere they want because they are using a blue badge, which isn't so

Wise words, John, and in view of Tony's experience I will display both in future. By the way, the badge will be up for renewal in May. Will we receive a new badge through the post, or do we have to re-apply?
