Thumbs down Bank error.

My friend paid 1.80 into his abount and the bank clerk wrongly credited is as 180, he withdrew this money and now the bank have realised the error and have put his account as minus 170. He is really panicking about this so is there any way out of this or is he just going to have to pay it all back? Thanks in advance for any advice you can give?

I think technically it's classed as fraud. Pretty sure he will have to pay it back but I'm sure somebody more learned than me will tell you the correct answer.

I would say he has to pay it back.

However I wouldnt be having any charges levied against me for bring unauthorised overdrawn.

He will have to pay it back. The money wasn't his. They may well have a good argument in favour of keeping the charges too because surely anyone knows if they have paid in £1.80 or £180.

yep the bank made an error,speedy, but yer friend commited fraud (in the banks eyes) he will just have to go with what they decide i think.seems all they will do is take re-payment, if that was me, i'd just live with it.

The banks mistake, but he knew it weren't his money to spend, he may be able to negotiate the charges depends on the bank and if he acts dumb, didn't realise the mistake etc

My hubby once put some money meant for a direct debit into my account by mistake. The error made him overdrawn, he managed to get away without paying the bank charges as it was a genuine mistake. Having read about the case in Blackburn it looks like your mate will have to pay the money back.

yep, its payback.


He knew the money wasn't his. A woman went to jail recently for an extreme case of this

Why did he bother paying £1.80 into the bank? It probably cost more than that to get to the branch.

Maybe he's not telling you everything, could have put £180 in and they credited £1800 and he's spent it, thats why he's panicking

no sympathy with this person at all,first of all he knew how much he paid into his account (sounds very fishy paying only 1.80 in) and then to withdraw 180 pounds when he discovered their mistake (according to "archbolds criminal law book" ) is deemed as fraud in the eyes off the law,and carrys a jail term of up to 6 months,he will also have to pay bank charges for going overdrawn intentionally and if they send him a letter will have to pay 25 pounds per letter, it is going to be a costly error of judgement on his part.
