Angry Hole In the Road = Damaged Car

I was driving to work the other day, driving down Black Abby Street, I then felt the car drop and bang the front end as I have gone into a pot hole.

Now this is my problem, it has defenatly damaged my bumper, no cracks just dislodged it and I have gained a water/coolent leak.

I reported it to the council/highways on the day it happened and they are now in the processs of fixing it.

They have said they will send me a claim form. Now I feel they will not want to pay for anything.

Has anyone had a claim of the council for damage to a vehicle due to road defects? If so how did you get on?

Is it the responsibility of HBC? These are the things I'm never sure of. My mother won a claim from the old Accy council many moons ago for a defective paving slab in Church Street. It gave way at one end as she stepped on it and she twisted her ankle, fell over and broke something. Can't remember what but she was compensated.

Highways Department.

I have received a claim form from them today.

Could do without the hassel TBH.

But im one to fight, so we'll have to see what happens next.

you should have told them this is why i pay the road tax on my car for you to do the road repares and the other road user,s two

Not happy.

Just had my car up on a ramp, looks like a major leak, just what i need, can afford to get it fixed for at least a month, and with it being a V6 you know its not going to be cheap.

Add the cost to fix the bumper make me feel like torching it (not that I would).

Plus I cant really drive it now.

Lets hope the council take responsability.

I feel like saying something along the lines of they'd do well to spend money on repairing roads instead of wasting it on things which are not necessary.

Ring them up and tell them that you are now car less and unless they make immediate plans to get it repaired you will get a hire car to see you on and will be passing the cost on to them.

You should never be out of pocket or put out by their negligence.

You don't actually say whats leaking, Radiator? pipework? etc.

one of my friends has a claim going through .....fell down a hole in john st ossy whilst pushing granchild in pram ....got a shattered knee.

Make a record of every single expense incurred which you would not otherwise have had. Keep receipts wherever possible.

one of me old mates, came off his scooter with a pothole in early 70s, he claimed against the council and was sucessful, cant remember the damage MRD its too far back. that was up Burnley Rd by the cemetry.

I once read of a similar case,it was a bit catch 22,if the hole had been previously reported and not rectified then the agreived had a case.
If the council was unaware of the hole,then there was no case to answer.
As they say across the pond,'go figure!'

I have tried this approach, they say I can go and get a car and if I Win they would compensate, if I loose its my cost.

I am not 100% Whats leaking, I had it up on a ramp but its a V6 so there is very little room to see and to locate a leak when you really dont know what your doing is mission impossible.

They also have advised that this could take upto 3 months to resolve.

I dont really want to get it fixed until the council (If they require to) have inspected it.

Will ring my Sols up later see what they suggest.
