hi just wondering if anyone got a parking ticket on the home bargain car park over christmas from a company called excel.

i didnt even know they even worked on there.i drive a biggish van and because of other peoples parking i had to park a tiny bit accross the white line and got a ticket for £60.was tryin to find out if anyone else had had this and if they managed to fight it.

its just not right.they must be sat waiting to prey on anything they can pull anyone for.i was only in shop for about 10 mins.no wonder people hate them so much.

check out the thread common law, Whatever you do dont respond to the ticket, if you do you have then entered into an agreement with the company. Read the thread first & check out common law, the ticket cannot be enforced.

Well when I go to my appeal against a ticket issued by Bury Council's wardens, if I win (which I should) I'll post on here. The thing is Gordon if you read about Common Law you might understand it a little better, instead of slating what you more than likely havent read about, if you have read it then you would be of the understanding that the ticket cannot be enforced,

Not sure what is going on here, the carpark is shared with I think 4 shops, it is not a pay to park , so what rules are being enforced for a ticket to be issued ?

Like I said earlier don't shop there, if nobody is shopping in these establishments it may just focus their minds a little, no customers no wages;)

What did you do to get a ticket and what is your defence?

Well I wish you luck!
Kenny started a thread on this in November and went all through Common Law and parking tickets at great length, I don't think he ever came on to announce his victory.

Simple answer, if its not the council its basically junk mail and treat it this way.

They cannot enforce the fine.

From a quick Google Excel seem a dodgy firm, just look at watchdogs website.;)

OR take the others advise stop moaning and pay the penalty. No wonder firms like Excel get away with it.

From Martin Lewis' 'Money saving Expert' website:

If you get an unfair ticket in a private (different rules apply to public tickets) car park.... don't pay it. These supposed 'fines' are the new Wild West, and whether the cowboys do it at supermarkets, retail parks, hospitals or housing estates, they're often unenforceable. This is a step by step guide on how to fight them.

Here's the link: Private Parking Tickets: Tickets are often invalid, don't pay....

I'm sure that there is a sign up on the car park telling drivers the rules of the car park.
Not that I am saying it is legal for them to issue penalties for infringement of these rules.

They have their own personnel who go round checking that cars have parked in the bays, and that you haven't overstayed the time limit. I'm not sure if the shops on the site pay the company to oversee the car park....but it is close to the town centre and as such is open to people abusing it by parking too long.

the legalities of these tickets is clear, they are NOT a fine or enforsable by any law enforcement agency. At best they are an invoice, they have never taken anyone to court to recover the charge that they are trying to apply. Throw it in the bin, you will then get about 12 different letters threatening to up the "Fine" to nearly 200 quid and from different debt collectors who are just Excel in another name(Roxbroughe IIRC?). They will even try calling you, just hang up. After about 12 months they give up.

how do I know this? because it happened to me on a different car park in Stockport but same bunch of cowboys. their sign was not visible on the route I drove in to the space or on my journey from the car to the shop I went in so I was unaware of any restriction.

the law actually says that they can issue a charge for their "Loss" however this has been rated at no more than £1 as there is no charge for parking oin these so a nominal charge is applied. I wouldn't suggest having anything to do with them, just throw all letters away and isgnore any calls.
